BETA PROGRAM NOTICE This document applies to the Kompunik Beta Program, a free, invitation-only research pilot operated by Joss Gillet (Founder of Kompunik). This is an experimental prototype with no service guarantee.

Welcome to Kompunik. These Terms of Use ("Terms") govern your access to and use of the Kompunik platform, including all courses, content, community features, and related services (collectively, the "Service") provided by Joss Gillet (Founder of Kompunik) ("Kompunik," "we," "us," or "our").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
1. Eligibility
1.1 Age Requirement
You must be at least sixteen (16) years of age to create an account and use the Service. By registering, you represent and warrant that you meet this age requirement.
1.2 Capacity
If you are between sixteen (16) and eighteen (18) years of age, you represent that you have obtained the consent of a parent or legal guardian to use the Service and that your parent or legal guardian has read and agrees to these Terms on your behalf.
1.3 Organization Users
If you are using the Service on behalf of an organization (company, university, or other entity), you represent and warrant that you have the authority to bind that organization to these Terms.
2. Account Registration
2.1 Account Creation
To access the Service, you must create an account by providing accurate and complete information, including your name, email address, and a secure password. Alternatively, if your organization has enabled single sign-on (SSO), you may authenticate via Google Workspace or Microsoft Entra ID.
2.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to:
- Choose a strong, unique password
- Not share your account credentials with any other person
- Notify us immediately at contact@kompunik.org if you become aware of any unauthorized access to your account
2.3 One Account Per Person
Each account is personal and non-transferable. You may not create multiple accounts or allow others to use your account.
3. License Grant
3.1 Limited License
Subject to your compliance with these Terms Kompunik grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial educational purposes.
3.2 Restrictions
You may not:
- Copy, reproduce, distribute, or publicly display any content from the Service
- Download, record, or capture audio tracks, video content, or course materials through any means
- Modify, adapt, translate, reverse-engineer, or create derivative works from the Service
- Use the Service or its content for any commercial purpose without a separate written license from Kompunik
- Share your account access with others or allow simultaneous use by multiple individuals
- Remove, alter, or obscure any copyright, trademark, or proprietary notices
3.3 License Termination
This license automatically terminates if you violate any provision of these Terms, or if your account is terminated for any reason.
4. Course Content
4.1 Content Description
The Service provides educational content focused on soft skills development, including but not limited to video lessons, audio tracks, questionnaires, self-assessments, quizzes, tactics, and community activities.
4.2 Content Changes
Kompunik reserves the right to add, modify, update, or remove course content at any time to improve the educational experience, correct errors, or reflect current best practices. We will endeavor to maintain the overall quality and scope of the courses.
4.3 No Academic Credit
The Service is designed for personal and professional development. Courses and certificates provided through the Service do not confer academic credit, professional certification, or any formal qualification unless explicitly stated in a separate written agreement.
4.4 Certificates
Upon successful completion of all required course components, you may be eligible to receive a certificate of completion. Certificates are subject to the terms outlined in our Honor Code and Copyright Policy.
5. Organization Accounts
5.1 Organization Administrators
Organizations designate one or more organization administrators ("Org Admins") who manage user access, seat assignments, and account settings on behalf of the organization.
5.2 Seat Management
Organization access is managed through a seat-based system. Org Admins are responsible for assigning and revoking seats within the limits of their contract. When a seat is revoked from a user, the user enters a seven (7) day grace period with read-only access to previously completed content.
5.3 Organization Contracts
Organization plans are governed by the terms of the applicable organization contract, which may include additional provisions regarding usage and data handling.
5.4 Branding
Organizations may customize certain visual elements of the Service (such as logo and display name) for their users. All customizations are subject to Kompunik's approval and must comply with our Acceptable Use Policy.
6. Termination
6.1 Termination by You
You may terminate your account at any time by contacting us at contact@kompunik.org. Upon termination, your access to the Service will cease immediately upon your request.
6.2 Termination by Kompunik
We may suspend or terminate your account immediately, without prior notice, if:
- You violate these Terms or any other Kompunik policy
- You engage in conduct that is harmful to other users, the Service, or Kompunik
- We are required to do so by law
6.3 Effect of Termination
Upon termination:
- Your license to use the Service immediately ceases
- Your access to course content, progress data, and community features is revoked
- Certificates previously issued remain verifiable but may include a notation if the account was terminated for cause
- Provisions of these Terms that by their nature should survive termination will continue to apply
7. Disclaimers
7.1 Service Provided "As Is"
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
7.2 No Guarantee of Results
Kompunik does not guarantee that use of the Service will lead to any particular educational outcome, professional advancement, or career benefit. The effectiveness of the learning experience depends on individual effort and engagement.
7.3 Service Availability
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We may perform scheduled or unscheduled maintenance that may temporarily affect availability.
8. Limitation of Liability
8.1 Cap on Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KOMPUNIK, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
8.2 Maximum Liability
JOSS GILLET (FOUNDER OF KOMPUNIK)'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED EUROS (EUR 100).
8.3 Exceptions
Nothing in these Terms shall exclude or limit liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any liability that cannot be excluded or limited under applicable law.
9. Governing Law and Jurisdiction
9.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.
9.2 Jurisdiction
Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Avignon, France, unless mandatory consumer protection laws provide otherwise.
9.3 Consumer Rights
If you are a consumer resident in the European Union, you retain any mandatory rights granted to you under the consumer protection laws of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.
10. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
11. Changes to These Terms
11.1 Notification
We may update these Terms from time to time. When we make material changes, we will notify you by email and/or through a prominent notice within the Service at least thirty (30) days before the changes take effect.
11.2 Continued Use
Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and may terminate your account.
12. Miscellaneous
12.1 Entire Agreement
These Terms, together with our Privacy Policy, Acceptable Use Policy, Honor Code, Copyright Policy, and Refund Policy, constitute the entire agreement between you and Kompunik regarding the Service.
12.2 Waiver
The failure of Kompunik to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
12.3 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. Kompunik may assign these Terms without restriction.
12.4 Language
These Terms are drafted in English. In the event of any conflict between the English version and any translated version, the English version shall prevail.

Beta-Specific Terms
Experimental Nature
This platform is an experimental prototype. Features may change, be removed, or malfunction without notice. No guarantee of availability, uptime, or performance is provided.
Data Handling
Data collected during the beta may be deleted at the end of the beta period. While we take reasonable care to protect your data, no guarantees are made regarding data persistence or backup.
Feedback Usage
Any feedback, suggestions, or ideas you provide during the beta may be used to improve the product without compensation or attribution.
No Financial Compensation
Participation in the beta is voluntary and unpaid. No financial compensation, credits, or refunds are applicable.
Limitation of Liability
Joss Gillet (Founder of Kompunik) shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of this beta platform. Use is entirely at your own risk.
Confidentiality (Optional)
You may encounter features or content that are not yet publicly available. While not legally binding, we kindly ask that you treat unreleased features with discretion.
No Commercial Relationship
This beta does not constitute a commercial service, contract, or subscription. No invoices will be issued, and no service-level agreements apply.
